Terms & Conditions :

General
The SM*SH Contest ('Contest') is organized by Maxis Mobile Services Sdn Bhd ('Maxis') and is open to all postpaid and prepaid subscribers of Maxis who: 

1. are residents of Malaysia;
2. are at least 18 years of age. Participants below the age of 18 years must obtain written parental consent to participate;
3. maintain an active Maxis account throughout the Contest Period (as defined below). The account must not be suspended or terminated for any reason whatsoever during this period.
4. actively purchased music downloads including Caller Ringtones from Music Unlimited for each of the past three (3) months.

The following group of persons shall not be eligible to participate in this Contest:

1. permanent and/or contract employees of Maxis (including its associated and related companies) and their immediate family members (children, parents, brothers and sisters, including spouses);
2. representatives, employees and/or agents of the content, advertising, promotion services providers for this Contest and their immediate family members (children, parents, brothers and sisters, including spouses)

Terms of the Contest

By participating in this Contest, you agree to be bound by the Terms & Conditions contained herein.

In addition to these Terms & Conditions, the terms and conditions applicable for the use of the service, including terms and conditions for the use of content as set out on http://www.maxis.com.my/personal/general/tnc_main.asp shall apply to you. Failure to comply with any applicable terms, conditions, rules, regulations, instructions or methods shall result in you being disqualified from the Contest.

The Contest shall in all respects be governed by the laws of Malaysia. However, it shall be your sole responsibility and obligation to ensure that you comply with and do not contravene any laws to which you may be personally subject to.

Contest Period
The Contest starts at 12.00am, 1st June 2012 to 11.59pm 24th June 2012 (' Period').

Participation
Step 1:
To participate in the Contest, you must purchase Sensasi Caller Ringtone Package which is listed in the SM*SH Contest page.

The rate applicable for each download of the Caller Ringtone Package is RM5.

Step 2:
You will receive SMS quiz on 26th June. Be the fastest to answer the questions correctly.

Winners
A total of eleven (11) participants will be selected as winners for the Contest during the Contest Period.

Winners shall be selected based on:

• the participants must have downloaded Sensasi Caller Ringtone Package
• Must answer questions correctly

Prize
Grand Prize (1 Winner) 
• 2x ticket to attend SM*SH showcase in Jakarta
• 2x return air ticket of an airline to be determined by Maxis
• 1x eating session with SM*SH
• Twin sharing room with breakfast for 3 days 2 nights
• Ground transfer from airport to hotel and back + hotel to venue and back

Special Prize (10 Winners)
1x SM*SH Autographed Album

Travel arrangements are for the exact details stipulated above. Should winners want to prolong their stay which exceeds the prize amount, the winners will need to settle the difference.

The participants are required to settle all their outstanding bills contributed by this Contest (if any) before 27th June 2012. The participant shall fully settle all their outstanding bills contributed by this Contest notwithstanding any dispute and/or disagreement on the part of the participant with regards to the contents of the said bills. In the event the participant fails to fully settle the outstanding bills contributed by this Contest, then the participant is disqualified from the Contest and the entitlement to any prize(s) and/or reward(s) will be automatically forfeited. Notwithstanding the disqualification of such participant or the forfeiture of such prize(s) and/or reward(s), the participant shall continue to be liable for such outstanding bills until full settlement of the same.

Each participant is only eligible to win one prize. Should participants have multiple phone numbers, and have purchased the Songs with such other phone numbers, such entries will not qualify for participation.

The winners of the Prizes will be notified via phone on 28th June 2012. Participants should keep their mobile phones switched on and their accounts active during this period. Maxis shall not be responsible or liable if the Winner cannot be contacted for any reason whatsoever following efforts by Maxis to contact the Winner. If Maxis is unable to reach the Winner, Maxis reserves the right to disqualify the Winner and to select the participant who is the next fastest to answer the question correctly to win the Prize.

Maxis' decision on the winners of the Prizes shall be final and conclusive and no correspondence, complaint or appeal shall be entertained by Maxis at any time during or after the Contest Period.

The Prize set out above shall be used/taken entirely at the risk of the Winners at all times and Maxis excludes all warranties and liabilities in connection with the Prize to the fullest extent permitted by law.

The Prize is non-transferable, non-assignable and non-exchangeable for cash.

The Prize may only be collected personally by the Winners and upon verification of the Winner's Identity Card (NRIC) number and mobile phone number.

The Winners shall be responsible for any additional costs, duties, taxes and/or other incidental expenses which may be incurred as a result of and/or related to the Winner's acceptance or use of the Prize.

By accepting the Prize, the Winners expressly grants permission to Maxis and its agencies to use the Winners’ name, photograph and/or likeness for purposes of advertising, editorial, promotional, marketing, trade and/or other purposes without further compensation and notice, unless prohibited by law.

Acceptance of the Prize by the Winners constitute a release and discharge of Maxis and its corporations, by from any and all liability, claims, demands, actions and/or damages which the Winners may have, whether known or unknown at the present time, of any nature whatsoever, arising out of or relating to:

1. the Contest;
2. personal injury and/or property damage, theft or loss suffered by the winner as a result of the use, employment and/or acceptance of the Prize or participation/presence in the Contest;
3. any tax liabilities in relation to the Contest, Prize and/or use or enjoyment of the same.

Rights
Maxis reserve the right:

• to change, amend, revise, supplement, delete, vary or add to these Terms & Conditions without prior notice at any time and you shall be bound to such changes, amendments, revisions, supplements, deletions, variations or additions.
• at any time, change any aspect of the Contest (including the Prizes and discontinuing the Contest) without prior notice.
• at its sole discretion to cancel, suspend, modify or delay the Contest or tabulation of votes in the event of unforeseen circumstances beyond its reasonable control. By continued participation in this Contest, you will be deemed to have accepted any changes, amendments, revisions, supplements, deletions, variations or additions, which may be published in www.maxis.com.my

Disclaimer 
This Contest and the Prize are provided on an "AS IS" basis without any representations or warranties of any kind whether express or implied. Maxis, its related and affiliated corporations disclaim and exclude all warranties relating to or in connection with the Contest and the Prize including warranties of merchantability, fitness for a particular purposes, security and accuracy.

In no event shall Maxis, its related and affiliated corporations, sponsors, agencies and representatives be liable to you or to anyone else for any loss or injury or any direct, indirect, special, exemplary, consequential damages, or any damages whatsoever, whether in contract, negligence or in tort, arising out of or in connection the Contest, the Prize and your participation in the Contest including (without limitation) any cancellation or postponement of the rewards by its organizers.

Maxis shall not be liable to the participants or for any other party for any loss or damage of whatsoever nature suffered by a participant or such other party as a result of participation or non-participation in the Contest or as a result of any act or omission on the part of Maxis.

Maxis is not responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, unauthorized access to, or alteration of, user or member communications, or any problems or technical malfunction of our telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of e-mail or players on account of technical problems or traffic congestion on the Internet.

Maxis reserves the right, in its sole discretion, to disqualify any participant that is found or suspected of tampering with the Contest submission process, the operation of this Contest or to be in violation of the Terms and Conditions. Maxis reserves the right to disqualify any participant and/or to forfeit any prize and/or reward from a participant it believes has undertaken fraudulent practice and/or activities or other activities harmful to this Contest or the Contest submission process. Fraudulent activities are deemed to include but not be limited to the following:

1. Any act of deceit and/or deception and/or cheating;
2. Submission of answers and/or entries and/or responses by any person other than the natural person who is the named Maxis subscriber participating in the Contest; and/or
3. Submission of answers and/or entries and/or responses wholly or partially by way of and/or generated by way of any electrical device, computer, pre-programmed modem or by any other method or device which contravenes the submission of answers and/or entries and/or responses as stipulated in part (ii) herein above
